Rules

1. CONTEST PERIOD AND IMPORTANT DATES:

The Canadian Cancer Society Driven to Quit Challenge (the “Contest”) starts at 8:00 AM EST on January 3, 2012 and continues until 11:59 PM EST on March 31, 2012 (the “Contest Period”). To be eligible, Registration (defined below) for each eligible entrant and his/her Buddy (defined below) must be completed (or postmarked, as applicable) by 11:59 PM EST on February 29, 2012 (the “Registration Deadline”).

2. ELIGIBILITY:

Entrant: Contest is open to residents of Ontario, who: (i) are (or will be) nineteen (19) years of age or older as of March 1, 2012; (ii) currently use and/or have used tobacco (defined as: cigarettes, cigars, cigarillos, pipes, chewing tobacco, snuff, water pipes and/or snus – collectively, “Tobacco”) at least once weekly for a minimum of ten (10) months (does not need to be 10 consecutive months) out of the calendar year immediately prior to January 1, 2012; (iii) have used Tobacco at least one hundred (100) times in his or her life; and (iv) are NOT a current employee (or domiciled with a current employee, whether related or not) of the Canadian Cancer Society, Ontario Division (the “Contest Sponsor”), the Ministry of Health Promotion and Sport, Ministry of Health and Long-Term Care, Ontario Public Health, McNeil Consumer Healthcare, or any of their respective advertising/promotional agencies (collectively, the “Excluded Entrants”).

Buddy: Each Buddy (defined below) must be a resident of Ontario who is (or will be) nineteen (19) years of age or older as of March 1, 2012. Excluded Entrants may qualify as a Buddy (defined below); however, any Buddy who is an Excluded Entrant will NOT be eligible for a Buddy Prize. In the event that an eligible Buddy Prize winner is an Excluded Entrant, the corresponding Buddy Prize will NOT be awarded in this Contest. For greater certainty, a Buddy may be a smoker or a non-smoker and may be of any relation to the entrant, provided that the Buddy meets the age requirement noted above and is a person other than the entrant him/herself.

The eligibility of each entrant and/or Buddy is subject to verification in the sole discretion of the Contest Sponsor. The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsor – including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Contest Sponsor in a timely manner may result in disqualification.

3. HOW TO REGISTER:

No purchase necessary. By participating, or purporting to participate, in this Contest, you are agreeing to be legally bound by the terms and conditions of these Official Rules and Regulations (the “Rules”). To register:

  • Find one (1) support buddy (the “Buddy”) who meets the eligibility criteria outlined above and who will support you in going Tobacco-free as outlined in these Rules;
  • Register yourself and your Buddy in one of the following four (4) ways (the “Registration”):
    • Follow the on-screen instructions and register at www.driventoquit.ca by 11:59 PM EST on February 29, 2012;
    • By calling the Smokers’ Helpline at 1-877-513-5333 by 9:00 PM EST on February 29, 2012;
    • By mailing a completed registration form to: The Driven to Quit Challenge, Canadian Cancer Society, Canadian Cancer Society 328 Mountain Park Ave. 3rd Floor Hamilton, ON. L8V 4X2. Mail-in entries must be post-marked by the Registration Deadline and must be received by no later than March 17, 2012;
    • By faxing a completed registration form to 1-800-706-0112 (toll free). Faxes must be received by 11:59 PM EST on February 29, 2012.

For Entrants: There is a limit of one (1) Registration per person/email address permitted, regardless of the method of Registration. For greater certainty, you can only use one (1) email address to register for, or otherwise participate in, the Contest. If it is discovered that you have attempted to: (i) obtain more than one (1) Registration per person/email address; and/or (ii) use (or attempt to use) multiple names, identities and/or more than one (1) email address to register for, or otherwise participate in, the Contest; then (in the sole discretion of the Contest Sponsor) you may be disqualified from the Contest. Your Registration is subject to disqualification in the sole discretion of the Contest Sponsor if the Registration is not fully completed and submitted by the dates and times listed above. Use (or attempted use) of multiple names, identities, email addresses and/or any automated, script, macro, robotic or other system(s) or program(s) to register for or otherwise participate in or disrupt this Contest is prohibited and is grounds for disqualification by the Contest Sponsor. The Releasees (defined below) take no responsibility for any lost, stolen, delayed, illegible, damaged, misdirected, late or destroyed Registrations.

For Buddies: There is no limit to the number of times that one person can be a Buddy in this Contest.

All Registrations, Main Entries and Survey Entries are subject to verification in the sole discretion of the Contest Sponsor. The Contest Sponsor reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsor – including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Contest Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Registration in this Contest will be the Contest Sponsor’s official clock.

Optional Registration for Survey Prize Draw:

At the time of Registration, each eligible entrant will be given the opportunity to answer several additional (non-mandatory) questions (the “Survey”).

  • If you have completed your Registration online, then you will need to complete the optional Survey on the registration form at the time of completing your Registration to be eligible. To be eligible, your Survey must be completed at the time of Registration and by no later than 11:59 PM EST on February 29, 2012; OR
  • If you have completed your Registration by telephone, then you will need to complete the optional Survey over the telephone at the time of completing your Registration to be eligible. To be eligible, your Survey must be completed at the time of Registration and by no later than 9:00 PM EST on February 29, 2012; OR
  • If you have completed your Registration by mail or fax, then you must check the box on the registration form and request that the Survey be mailed to you. Once you have received a copy of the Survey from the Contest Sponsor, you must complete it and mail or fax it back to the Contest Sponsor (as outlined above in Rule 3). To be eligible, your completed Survey must be postmarked by March 17, 2012 and received by no later than March 24, 2012.

Each entrant who completes the Survey and returns it by the dates and times listed above will receive one (1) entry in the random prize draw for the Survey Prize (the “Survey Entry”).

4. HOW TO EARN ONE (1) MAIN ENTRY ONCE REGISTERED:

To earn one (1) Main Entry (defined below) in the main random prize draw (for the Grand Prize, Secondary Prizes and Regional Prizes) an eligible entrant who has completed his/her Registration (as outlined above) must meet the eligibility criteria and remain Tobacco-free from March 1, 2012 through and including March 31, 2012 (or until all winners are confirmed for this Contest as described below). Tobacco-free or smoke-free means no use of commercial Tobacco products of any kind. Entrants are permitted to use nicotine replacement therapies (e.g. patch, gum, inhaler or lozenge) and/or prescription medication(s). As the use of electronic cigarettes (e-cigarettes) is not regulated in Canada, not enough is known about the nicotine levels in these products. Participants are advised not to use electronic cigarettes, as they may produce a positive cotinine level in a urine test, deeming a participant ineligible to win in The Driven to Quit Challenge, even if tobacco was not used.

Any eligible entrant who has completed his/her Registration (as outlined above) and who quits smoking and/or Tobacco use and remains Tobacco-free from March 1, 2012 through and including March 31, 2012 (or until all winners are confirmed for this Contest as described below) will earn one (1) Main Entry in the main random prize draw (the “Main Entry”).

5. THE PRIZES AND APPROXIMATE RETAIL VALUES:

MAIN PRIZE DRAW:

Grand Prize: There is one (1) Grand Prize available to be won consisting of the declared Grand Prize winner’s choice of either: (a) a 2012 Ford Fusion hybrid [U4K -4WD U5K] with an approximate retail value of $32,000; OR (b) a 2012 Ford Edge [SEL FWD K3J] with an approximate retail value of $32,000 (the “Grand Prize”). Grand Prize includes destination/freight charges and all applicable taxes. Without limiting the generality of the foregoing, the following general conditions apply to the Grand Prize: (i) Grand Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted at Contest Sponsor’s option); (ii) Contest Sponsor reserves the right to substitute the Grand Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including without limitation, but solely at the Contest Sponsor’s sole discretion, a cash award; (iii) colour and other specifics of the Grand Prize will be at the sole discretion of the Contest Sponsor and subject to availability; (iv) manufacturer’s warranty applies to the Grand Prize; (v) upon notification, the confirmed Grand Prize winner will be required to personally take delivery of the Grand Prize from a Ford dealership within Canada reasonably close to the Grand Prize winner’s place of residence in Canada as designated by Contest Sponsor, in its sole discretion, and present adequate personal identification; (vi) Grand Prize will not be released unless and until the confirmed Grand Prize winner first shows proof of having a valid driver’s license (equivalent to a full “G” class license in Ontario) and proof of satisfactory insurance (note: in the event the declared Grand Prize winner does not have or cannot get a valid license and evidence of insurance, he/she will be permitted to transfer the Grand Prize to a family member of his/her choice with a license and insurance who must sign all appropriate releases); (vii) Grand Prize winner is solely responsible for all taxes and expenses that are not included in the Grand Prize description above, including, but not limited to: registration and license fees, insurance, additional accessories and all other costs associated with any upgrade or option packages that the Grand Prize winner may request; and (viii) Grand Prize winner is solely responsible for all costs not expressly described herein including, without limitation, costs associated with obtaining a valid driver’s license, license plates, registration, insurance and/or fuel/gas.

Secondary Prizes: There are two (2) Secondary Prizes available to be won, each consisting of one $5,000 CDN travel voucher valid for redemption through the Canadian Automobile Association (CAA). Confirmed Secondary Prize winners are solely responsible for making all arrangements with CAA Travel to redeem the vouchers. Retail value of each Secondary Prize is $5,000.

Regional Prizes: There are seven (7) Regional Prizes available to be won (one per Region – defined below), each consisting of one (1) Regional Prize in the amount of $2,000 CDN (payable in the form of a cheque).

Buddy Prizes: There are ten (10) Buddy Prizes available to be won, each consisting of one (1) Buddy Prize in the amount of $200 CDN (payable in the form of a cheque).

SURVEY PRIZE DRAW:

Survey Prize: There is one (1) Survey Prize available to be won consisting of one (1) Survey Prize in the amount of $250 CDN (payable in the form of a cheque). NOTE: THERE IS NO CORRESPONDING BUDDY PRIZE FOR THE SURVEY PRIZE

6. THE PRIZE CONDITIONS:

Without limiting the generality of the forgoing, the following conditions apply to ALL prizes in this Contest: (i) each prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted at Contest Sponsor’s option); (ii) there are no substitutions permitted, except at Contest Sponsor’s option; and (iii) Contest Sponsor reserves the right, in its sole discretion, to substitute any prize or a component thereof with a prize of equal or greater value, including, without limitation, but at Contest Sponsor’s sole discretion, a cash award.

Limits on Prizing:

  • An entrant can win: (i) the Survey Prize; and/or (iii) only one (1) of either the Grand Prize, Secondary Prize or a Regional Prize.
  • A Buddy is eligible to win multiple Buddy Prizes since a single individual can be a Buddy for multiple entrants.

7. PRIZE WINNER SELECTION PROCESS:

On April 1, 2012 (the “Draw Date”) in Toronto, Ontario at approximately 9:00 AM EST, a series of random draws for all prizes will be conducted by a representative of the Contest Sponsor as follows:

MAIN PRIZE DRAW:

Grand Prize and Secondary Prizes: Three (3) eligible entrants will be selected by random draw from among all eligible Main Entries received in accordance with these Rules. The first eligible entrant drawn will be eligible to win the Grand Prize (subject to compliance with these Rules), and the second and third eligible entrants drawn will each be eligible to win a Secondary Prize (subject to compliance with these Rules). The odds of winning depend on the number of eligible Main Entries that are received in accordance with these Rules.

Regional Prizes: Seven (7) eligible entrants will be selected by random draw from among all eligible Main Entries (minus the previously selected Grand Prize and Secondary Prize entries) received in accordance with these Rules in each of the seven (7) regions (the “Regions”). The Regions are determined by the seven Ontario provincial tobacco control area network regions, as defined by the Government of Ontario. An entrant’s Main Entry will automatically be classified in a particular Region by the Contest Sponsor, in its sole discretion, based on the entrant’s postal code submitted at the time of Registration. The odds of winning depend on the number of eligible Main Entries (minus the previously selected Grand Prize and Secondary Prize entries) that are received in accordance with these Rules in each Region. Note: entrants can confirm what Region they are in by contacting their local public health unit.

Buddy Prizes: The Buddy associated with each eligible prize winner will be eligible to win a Buddy Prize (subject to compliance with these Rules). A Buddy is not required to live within the same Region as the entrant to be eligible to win a Buddy Prize. Odds of winning a Buddy Prize are the same as the odds of winning the corresponding prize (as outlined above).

SURVEY PRIZE DRAW:

Survey Prize: One (1) eligible entrant will be selected by random draw from among all eligible Survey Entries that are received in accordance with these Rules. The odds of winning depend on the number of eligible Survey Entries that are received in accordance with these Rules. NOTE: THERE IS NO CORRESPONDING BUDDY PRIZE FOR THE SURVEY PRIZE AND SURVEY PRIZE ENTRANTS DO NOT NEED TO REMAIN TOBACCO-FREE TO QUALIFY

8. WINNER NOTIFICATION, VERIFICATION AND DECLARATION:

The Sponsor or its designated representative will make a maximum of six (6) attempts to contact each selected entrant (and his/her corresponding Buddy) by telephone (using the information provided at the time of Registration) within three (3) days of the Draw Date, or 72 hours after first attempt at contact has been made (whichever occurs first). If a selected entrant (or his/her corresponding Buddy) cannot be contacted within the time frames stipulated above, or there is a return of any notification as undeliverable; then: (i) in the case of a selected entrant, he/she and his/her corresponding Buddy will be disqualified and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible Main Entries (or Survey Entries, if applicable) in accordance with the procedures outlined above in Rule 7; and (ii) in the case of a Buddy only, he/she will be disqualified and the corresponding Buddy Prize will not be awarded in this Contest.

Each selected entrant (and his/her corresponding Buddy) may be requested to provide proof of identification and eligibility. In addition, each Buddy will be asked to confirm (via a signed declaration) that his/her corresponding selected entrant has, in fact, remained Tobacco-free in accordance with these Rules. Each selected entrant will then be required to take a urine test to be administered by DriverCheck at a mutually convenient location in Ontario within 2-3 days following notification, for the purposes of verifying his/her Tobacco-free status. In the event that a selected entrant has used a sacred/traditional (non-commercial) tobacco product during the Contest Period, or at any time before the mandatory urine test, then he/she must declare such use to the Contest Sponsor prior to the urine test. Each selected entrant will need to remain Tobacco-free until after testing is completed, and while testing results are evaluated, which can take up to three (3) weeks. Please note, we strongly recommend that all entrants remain Tobacco-free until after the winners are formally announced, since alternate eligible entrant(s) may need to be selected in accordance with these Rules. If a selected entrant fails his/her urine test (as determined by the Contest Sponsor in its sole discretion), even if the Tobacco-use was following March 31, 2012, then he/she will be disqualified and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible Main Entries in accordance with the procedures outlined above in Rule 7.

FOR ALL PRIZES:

IN ADDITION, Before being declared a CONFIRMED winner, each selected entrant (and his/her corresponding Buddy) will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid to be administered by telephone at a mutually convenient time; and (b) sign and return within ten (10) business days of notification the Contest Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the applicable prize as awarded; (iii) releases the Canadian Cancer Society, Ontario Division, the Ministry of Health Promotion and Sport, Ministry of Health and Long-Term Care, Ontario Public Health, McNeil Consumer Healthcare, and all of their respective advertising/promotional agencies, and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of a prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If a selected entrant (or his/her corresponding Buddy): (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot accept the applicable prize for any reason; then: (i) in the case of a selected entrant, he/she and his/her corresponding Buddy will be disqualified and the Contest Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible Main Entries (or Survey Entries, if applicable) in accordance with the procedures outlined above in Rule 7; and (ii) in the case of a Buddy only, he/she will be disqualified and the corresponding Buddy Prize will not be awarded in this Contest.

All declared prize winners are scheduled to be publicly announced on or about April 23, 2012.

9. GENERAL CONDITIONS:

All Entries/Registrations become the property of the Contest Sponsor. The Releasees assume no responsibility for lost, stolen, delayed, damaged, illegible, incomplete, postage-due, garbled or misdirected Entries/Registrations/Survey Entries or Entries/Registrations/Survey Entries that have been submitted through illicit means, or do not conform to or satisfy these Rules. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Contest Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.

The Releasees will not be liable for any failure of the Website during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer online systems, servers, access providers, computer equipment or software; for the failure of any Main Entry/Registration/Survey Entry to be received for any reason including, but not limited to, technical problems or traffic congestion on the internet or at any website; or any combination of the above. Further, the Releasees will not be liable for any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating or downloading any material in the Contest.

By entering this Contest, each confirmed winner of a prize will have the option of attending the Contest Sponsor’s official Prize Presentation in Toronto, Ontario at a date and location specified by the Contest Sponsor. Declared winners deemed by the Contest Sponsor, in its sole discretion, to be located at a reasonable distance from the Prize Presentation location, may be reimbursed for travel, meal and accommodation expenses based on policies of the Contest Sponsor. The Contest Sponsor will contact each declared prize winner for the purposes of arranging his/her attendance at the Prize Presentation.

If the identity of an online entrant or Buddy is disputed, the authorized account holder of the e-mail address submitted at the time of Registration will be deemed to be the entrant/Buddy. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant/Buddy may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All online Entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid online Registration in this Contest will be the Contest Sponsor’s server machine(s). Automated and/or repetitive submission of Registrations (including, but not limited to, Registrations made using any script, macro, bot or contest service) will be disqualified and transmissions from these or related email or IP addresses may be blocked. When a Registration is deemed to be duplicated by the Contest Sponsor, in its sole discretion, only the first entry may be included in the applicable prize draw(s).

The Contest Sponsor reserves the right, in its sole discretion, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, for any reason, including, without limitation, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Contest Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Contest Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.

The Contest Sponsor collects the personal information of participants and Buddies for the purposes of registration, program evaluation, administration of the Contest and to keep you informed about the Contest. The Contest Sponsor will not share any personal information about entrants with any other party, unless otherwise indicated. The personal information collected for this Contest will not be used for any other purposes unless entrants/Buddies provide explicit permission as indicated at the time of Registration. By participating, or purporting to participate, in this Contest, each participant/Buddy agrees to release and hold harmless the Releasees from any liability for any loss or damage of any kind to the participant/Buddy or any other person in connection with this Contest or participation in any Contest related activities, including, but not limited to, the taking of a urine test or, if confirmed as a winner, the use or misuse of a prize or any portion of a prize including personal injury, death or property damage. This Contest will run in accordance with these Rules, subject to amendment by the Contest Sponsor. All participants must comply with these Rules, and will be deemed to have received and understood these Rules if they participate, or purport to participate, in the Contest.

The Contest Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant, Buddy, Registration, Main Entry and/or Survey Entry with these Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Contest Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules.

10. INTELLECTUAL PROPERTY

All intellectual property used by the Contest Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Contest Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

11. LANGUAGE DISCREPANCY

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Contest registration form and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control.
